Carnival cruise line guest screening policy re: guests with specified felony convictions.

Carnival Cruise Line (“Carnival”) reserves the right to use consumer reports prepared by a third-party consumer reporting agency, to conduct a criminal background check for guests who have booked a Carnival cruise. This criminal background check will be done to safeguard Carnival guests and crewmembers. Given that cruise vessels are at sea, with many guests and crew in close contact for an extended period, Carnival has a legitimate business purpose for conducting these background checks.

The Fair Credit Reporting Act (“FCRA”) regulates both providers and users of consumer reports. A member of Carnival’s Security Services Department or a member of Carnival management may arrange for the services of a consumer reporting agency to conduct a criminal background check for persons convicted of felonies involving aggravated physical and/or sexual assault, armed robbery and related offenses, and other violent crimes. Carnival may deny boarding to guests with these felonies on their records. No background checks will be performed by Carnival until a guest has booked a cruise.

Carnival will provide a notice of adverse action to guests in the event it denies passage based on information in a consumer report. That information will be disclosed via email to the booked guest at the email address on file for the booking. Carnival will also provide guests notice of the right to obtain the consumer report and required contact information for the credit reporting agency, as required by FCRA.

Consumer reports generated by the consumer reporting agency will be shared solely among members of Carnival’s Security Services Department and with limited members of management on a need-to-know basis only. Persons to whom a consumer report is disclosed will be given a copy of this policy along with the consumer report. The department head of Carnival’s Security Services Department will conduct an audit of these disclosure restrictions every six months to ensure that security personnel and management are aware of this policy.

Consumer reports received by Carnival will be retained for a period of three years from the date of the end of the relevant planned cruise. During such time the consumer reports will be accessible only, as described above, on a need-to-know basis. At the end of this period, Carnival will ensure that all paper copies of the consumer reports have been shredded in secure facilities and that all electronic copies of the consumer reports have been deleted and made irretrievable. This information will be collected, used and retained in compliance with Carnival’s privacy guidelines and will be handled per Carnival’s privacy notice .

Unauthorized use or disclosure of consumer reports by an employee of Carnival outside the scope of this policy may be grounds for disciplinary action, including dismissal.

Is anyone aware as to whether someone with a felony record is allow to go on a cruise? Would the cruise line deny someone? My partner committed a crime years ago, before sobriety entered his life, He is not on probation but a felony charge would show up on a background check.

I was going to just call Carnival and ask but unfortunately, I am not sure I trust a customer service representative with such an important question that if answered incorrectly, could cause us to be declined entry on to the ship.

As long as there are no active warrants out for his arrest, you should be fine. They don't deny boarding to someone who has past a criminal record.

I think he should be totally fine. I'm sure he already paid his time for his crime! Glad to hear he turned his life around. [emoji847]

Not sure about the Caribbean, but any cruise with a Canadian port is probably out. Canada is very strict on who is allowed to enter, and any one with a criminal history is inadmissible. You would probably be best researching the entry requirements of the specific countries you want to visit.

Never known of any cruise line to do a background check for its passengers. Just Canada as someone else mentioned.

Should not be a problem as long as there are no outstanding warrants. However it may be wise to check online for any countries that you are stopping at to see if there are any local requirements.

It certainly would not be a hinderance if your partner was looking to get on the Carnival board of directors. :)

You need to check every country that you are going to and make sure that they can enter in with a felony record.

Better check with Consulates of countries to be visited just to be sure as the type of crime committed may be a factor.

Carnival nor CBP don't check criminal history. CBP will normally scan for active arrest warrants or other detainable info listed on NCIC.

While technically a felon is one who commits a felony, referring to someone as a felon denotes (at least to me) a serious crime like armed robbery, rape, murder, etc. That being said, if this a closed loop cruise and the cruise departs and return to the same US port and the individual has a valid birth certificate and drivers license they should be fine.

So, the question is would the USA allow you on the ship? Every country has a set of laws and many countries will not allow those committing certain crimes into their country. (Turn on CNN for a current example of how countries can make the rules).

The answer to your question is to check with the countries the cruise line is sailing to. Most likely it will be OK, but please don't take advice from a bunch of strangers with no legal knowledge of the countries being visited.

It may be a fine point but when CBP checks for arrest warrants they are doing a criminal history check (via name check, of course).

OP, the checks are done by CBP while the cruise is ongoing and from what I've read from other's experience if something came up that would prevent someone from entering a country (such as Canada) then the passenger would not be allowed to disembark in that port.

Once someone is convicted of a felony (regardless of the charge) they lose many of their Constitutional rights like sitting on a jury, carrying a firearm or voting. What is a crime in one state, be it felony or misdemeanor, may either not be a crime in another or may be deemed a more serious crime, say making a misdemeanor in one state a felony in another for certain purposes. This confusion is even more true when you cross international boundaries.

OP- please disregard all those that speculate on their personal opinion and contact each country that you plan to visit to determine if it will be an issue. Do not rely on other's experiences or thoughts as things can change, even if they were on the same trip you are considering. A search of Carnival's website shows that there is no prohibition on a felon traveling with them. So really, you issue is only the countries you will be visiting.

The cruise line will NOT stop your partner from boarding the ship. IF the cruise is a closed port cruise(from one USA port and then back to that port) then they don't even require passports and the local authorities are not involved EXCEPT Canada which has very stringent rules about entering its borders.

Apparently he was on probation and as we returned to port my husband and I heard them calling his name on the loud speaker then we saw him being escorted away from the port. I know it doesnt answer the current question but just an interesting story.

Not really....they are checking the NCIC wanted file for a match using the name and DOB. The criminal history file is totally different and is outputted in the form of a RAP sheet. Two separate things.

Then how do the Canadian authorities find out that there is someone onboard that has a DUI record? As I understand it the information pulled by CBP is shared with them (and I have read many cases of passengers being kept on the ship because of this).

We took a cruise last month and one person that went with was a convicted felon. No problem getting on the ship but he was flagged getting off the ship. Being his conviction was drugs, they pulled him and his family to secondary and searched them for drugs. I hated it for him and his family. They told him it was because of his drug conviction and were really nice to him. He understood they were just doing their job.

The RCMP have access to NCIC and physically pull criminal histories of Americans entering the country. The refuse entry if there is any history of what would be an indictable offense in Canada, not just DUI.

Other countries also have similar access and may to their own investigation as to who they allow into their country.

Cruise line jobs are available even if you have a record. Your primary concern will be traveling from one country to another. This is especially true for Canada and the United States. Border guards in these countries have a lot of information at their fingertips. They share databases about each other’s citizens.

This information is not necessarily shared with countries in the south. However, applying for a pardon in your state can help seal your record and qualify for visas to other countries. In Canada, you can apply for a pardon from the Parole Board of Canada. Unfortunately, Canada and the US do not recognize each other’s pardons. They will still take a look at your record. A criminal record can deny you entry to either country.

Cruise line jobs and crossing the border

While many people think about the Caribbean when they think about cruising, there are many ports of call in Canada. On the West Coast, ships will leave from Victoria and Vancouver and travel up the coast to Alaska. On the east coast, cruises will visit the historic cities of Halifax and St. John’s. Often a cruise will even start in Canada when the ultimate destination is south.

A pardon is not necessary, but it may help you land the job. Often recruiters and companies will conduct background checks. Entering the US

If you are a Canadian, you can apply for a US Entry Waiver . A US Entry Waiver is issued from anywhere from six months to five years. You will need to provide court and record checks, reference letters, information about your income and the circumstances of your conviction.

Entering Canada

Americans have more options for entering Canada . They can enter on a Temporary Resident Permit, apply for Criminal Rehabilitation, or simply be “deemed rehabilitated”. What option you qualify for depends on how long ago your conviction was. As well, officials will look at how serious it was. You need to rely on the Criminal Code of Canada to determine how seriously your conviction will be treated. That’s why it’s good to get expert advice.

If you only have one minor (“summary”) conviction you are not ineligible. However, check with us about whether your conviction would be considered summary in Canada. Americans with impaired driving charges often run into trouble at the border. This is because they have a misdemeanor charge. However, Canadian border officials will not treat it that way.

Temporary Resident Permit (TRP): If your conviction was in the last five years or you are eligible for criminal rehabilitation, but have not yet completed the application, you can apply for a Temporary Resident Permit. This is issued for a single purpose. For example, if you know that you will be making a port of call in Vancouver on a certain date you can apply for a TRP for that visit. You may even be able to get one for the entire season. However, this is a temporary solution.

Criminal Rehabilitation: After five years from sentencing you may be eligible for Criminal Rehabilitation. This is a permanent solution. It will let you come and go. You need to apply for this, but once you have it, you don’t need to reapply as long as your record is clean.

Deemed Rehabilitation: If you only have one offence on your record and it has been at least 10 years since you completed the sentence, you may be deemed rehabilitated. You do not need to apply for deemed rehabilitation. However, you may want to get an expert opinion, such as a letter from a lawyer that states that you can cross the border.

If you’ve never been on a cruise , you don’t know what you’re missing! And for those of you who have been, you’re probably ready to go see those clear blue waters once again… But, minor snag–if you’ve ever been convicted of a felony offense, booking that next trip to the Bahamas or whatever dream destination you have in mind may or may not be a problem. Don’t worry; we are here to dig into the issue for you, and hopefully answer the question: Can a Felon Go on a Cruise?

Short Answer: Yes, a felon can go on a cruise but not all types of cruises.  It depends on the type of cruise and what the destinations, or ports you will be visiting while on the cruise ship. Not all ports and countries will allow US felons on their soil or waterways.

To begin–we all know that felons have many of their rights severely restricted even after they have completed their mandatory sentence in prison. Sometimes these rights can be restored; sometimes not. But is it a “right” to be able to board a cruise ship?

Not really, but we certainly want to be able to go on vacation, at a minimum, and we also want the ability to travel and see the world, whether by land, air, or sea. After all, millions of travelers pack their bags and go on cruises every year, stopping in one port after another, many of which are in different countries all together.

And therein lies part of the problem… You see, the question is not so much about whether a felon can go on a cruise, but instead what type of cruises can a felon go on!

Everyone loves heading to the Caribbean , for instance. The destination hogs the lion’s share of tourists annually (and for good reason, as you know if you’ve been!). So we can use that as an exampIe. If you want a cruise like that, which goes from port A (say, Miami) to port B, then back to port A, then you’re on a “closed loop” tour…you return from whence you came. That’s the simplest kind, and easier for a felon to take.

If your ship starts in one location, like Miami, but ends in a different port, like Tampa (this is hypothetical; I don’t know of any specific cruises that depart Miami and return to Tampa), then you’re on what is called an “open loop.” These are a little harder in some cases for a felon to get passage on…

Closed Loop Cruises

For an American citizen wishing to go on a closed loop cruise they will need proof of citizenship, such as birth certificate and some type of government issued photo identification such as a driving license.  Passports are recommended but not necessary.

Open Loop Cruise

Open loop cruise passengers are going to need a passport, in case a passenger misses the boat and has to fly, or if they need to fly for some other emergency reason. And naturally passports are needed if you are visiting a port in a foreign country. You might even need a passport if the vessel itself somehow runs afoul of the law, for whatever reason. You never know! Those sea captains can be a shady lot! LOL

Avoid the Dangers by Knowing the Law

The point is, only open loop trips require passports, so you may want to see our article on Can a Felon Get a Passport? Not all countries allow felons to enter, or to obtain a visa, so you need to ensure you pay close attention to every port of call on your proposed itinerary. IT MAY NOT BE POSSIBLE FOR A FELON TO GET A VISA DEPENDING ON THE COUNTRY. If in doubt, double check with the official government websites of any foreign nations your cruise ship might be paying a call to.  You can find visa, passport and other information about every country in the world here .

You can also contact a travel agent, but be advised they may not be experts on every issue; they are one point of information, but should not necessarily your only one. Similarly, you might wish to get in touch with your parole officer if you have one, not only to inform them of any upcoming desired trips, but to ask their advice.

Once you’re certain you can travel, make sure you communicate clearly with the cruise line itself. They can help you navigate any potential issues with any port of call embassies, in case there’s any chance at all of a hang up due to your prior felony conviction. The last thing you or they want is to land in legal hot water on the high seas!

What If You Just Stay on the Boat?

Well, now where is the fun in that? But joking aside, it is an unlikely option that a felon could simply state their intent to never leave the boat when it docks in some foreign country. Whether you intend to stay on board is not the point. It’s always possible you might try to get off, and therefore they must ensure you have the legal ability to do so. Hence, you’ll need to be able to have the required documents on hand if asked ( passport and applicable visa ). Anytime the ship pulls into dock, you have to be ready to show proof of your eligibility to depart the vessel, if needed.

Sure, if you end up there and cannot provide proof, then they can simply force you to stay on board, but that’s not a position you want to put them in!

Many Countries Outrightly Ban US Felons

Felons are typically banned from taking cruises to certain countries such as the United Kingdom, Australia (ironic, since it was founded as a place to stash unwanted criminals!), and New Zealand. Don’t let it get you down. The world is a very big place and there are hundreds of other options! Again, just make sure to do your research on each specific country’s requirements–well in advance of purchasing a ticket!

It’s possible the cruise line or travel agent you book with won’t offer a refund, just because you may’ve overlooked a visa/passport requirement and later discovered you aren’t able to make that specific journey. And indeed, if you later realize you made a mistake, but try to board anyhow– if they see you aren’t authorized to get off the boat at one of the points of destination, then they can cancel your trip on the spot…and again, not give a refund!

Parole and Cruising Often Don’t Mix

Getting back to that parole officer for a second…if you happen to be on probation or parole, then it is up to the state itself whether you meet the eligibility requirements to travel on a ship bound for an international port. So always check in with your parole officer, to ensure there are no specific conditions which might prevent you from such a vacation abroad! And even if you are able to go, just note that you might have some immigration officers standing by to ask you about your conviction.

DUI/DWI and Canada

A DWI conviction can prevent you from entering Canada, and the question may arise at the border itself. Don’t get yourself in a bind, where you wind up being deported! Again, just do your research on each country on your planned trip, speak with your parole officer, check out the embassy websites , and talk to the travel agent and cruise line if needed.
